How much can a Virginia landlord charge for a rental application?

Up to $50 as the landlord's own fee ($32 for HUD-regulated housing), plus the actual amount a third-party screening service charges. The fee is non-refundable, so ask what screening it covers before paying.

Do I get my application deposit back if I'm rejected in Virginia?

Yes. An application deposit (unlike the fee) is refundable minus actual documented expenses: within 20 days of rejection, or within 10 days if you paid by cash, certified check, cashier's check, or money order.

What's the security deposit limit in Virginia?

Two months' rent, counting all deposits however they're labeled. It must be returned within 45 days of move-out with an itemized statement.

Can Virginia landlords refuse Section 8 vouchers?

Generally no: source of funds has been protected statewide since 2020. Two exceptions: owners of 4 or fewer Virginia rental units are exempt, and a landlord may move on if the voucher isn't approved within 15 days of the request for tenancy approval.

Do I have to disclose sealed records on a Virginia application?

No. Since July 1, 2026, landlords may not require disclosure of sealed arrests, charges, or convictions, and any criminal-history question must carry a notice saying so. This form's background question includes that notice.
